The following terms and conditions will apply to the use of the online store under the trademark www.bacci.gr at email address www.bacci.gr. Any user who enters and trades with, or makes use of, the e-shop’s services (hereinafter referred to as “visitor” and/or “user” or “customer” dependent on whether they only visit the store, place an order or sell products and services) is hereby deemed to consent to and accept unconditionally the following terms, without exception. Any user not agreeing with these terms must undertake to refrain from visiting or using the site, and from entering into any transaction with it, or any other use of the e-shop.

General Terms

The COMPANY reserves the right to modify or revise freely these terms and conditions of use as well as transactions from the online store whenever it deems it necessary, and undertakes to inform consumers of such changes via the pages of the e-shop. All contracts via the e-shop will be drawn up in the Greek language.

Information & Products Provided

The COMPANY is committed to ensuring that all information provided in the online store is accurate, truthful and complete, as regards both the identity of the COMPANY and all transactions via the online store. The COMPANY may not, in all good faith, be held responsible for nor bound by electronic data entries made in error / omission by the general public and is entitled to correct them whenever they perceive their existence.

Limitation of Liability

 

THE COMPANY in the context of its transactions via the e-shop is not responsible and shall not be liable for compensation for any fault or damage arising from the cancellation, non-execution or delay of orders, for any reason. It does not guarantee the availability of products displayed in the online store, but informs the customer of their availability or unavailability based on the information available and undertakes, in the event of a change in this information, to inform customers in good time of unavailability, in which case it shall have no further liability. The online store provides content (ie information, names, photos, illustrations), products and services available through the site “as seen”. The user/customer agrees and undertakes to use the services, information and data of the online store as provided for by law and based on the rules of good faith and business ethics. This licence is not a transfer of title to the site or its data and is subject to the following restrictions: (1) you must keep on all copies of the Site and its data, notices of copyright and other proprietary rights, and (2) you may not modify the site and its details in any way or reproduce or present it publicly, or distribute or otherwise use the Website or its data for any public or commercial purpose unless otherwise permitted herein.

In addition, you may be asked for specific information, such as order shipping/collection details, billing information, or details relating to a quotation you have requested. Bacci.gr uses the information you provide to us during online form submission in order to contact you about (i) the delivery of your order to you, (ii) confirmation of your identify as necessary, (iii) new or alternative products offered by bacci.gr, (iv) special offers from bacci.gr, (v) activation of telephone or internet service, (vi) receiving prizes following a competition draw. You have the option to choose whether or not to receive such communications from bacci.gr by sending your request via e-mail to info@bacci.gr.

 

Access to Information. The processing of every order requires the collection of personal information, for delivery or reservation of an order. Returns Policy

 

The COMPANY by providing the online store allows you, via the full descriptions on its pages, to access available products from your computer screen quickly and easily. Wishing to highlight the benefits of using the internet for everyday purchases, we set out the terms and conditions for returning defective or non-defective products below.

Product Returns due to delivery error

In cases where delivery of goods differs from those sold, in type or quantity, or an item previously agreed in writing with the COMPANY is missing, the customer shall return the products for us to inspect and determine the error. In such cases the costs of returning the products to the company as well as the cost of returning them to the customer are borne by the COMPANY provided the company’s choice of carrier is accepted.

Returning defective products

Should it be determined that the article has a manufacturing defect, provided this is confirmed by the authorised repairer providing the warranty or if the Company itself provides the guarantee directly, the following shall apply:

• The warranty is provided for a limited period of time as stated in the product’s features. After the end of this period, repair or replacement of the product is possible with an additional charge subject to the customer’s consent.

• The product to be replaced must be returned with all accompanying documents (eg ID card, retail receipt and so on) and full packaging.

• Products will be returned either through the Company’s own transport means or by courier, or at one of the stores owned by COMPANY under the brand “bacci.gr” nationwide. In cases of return by courier, the customer is charged the cost of the shipment to the COMPANY and the COMPANY is charged the cost of dispatching the replaced or repaired product.

• After products are returned, the defect reported by the customer is checked and the results of the inspection communicated to him.

• If a defect is found, the product is repaired or replaced, otherwise the transaction is cancelled if the product cannot be repaired within a reasonable time and the COMPANY cannot find another product of equal or better specification or equivalent value as replacement. If the transaction is cancelled, refund will be via the same method by which the customer made the original payment to the COMPANY.

• In the case of credit card payment, the COMPANY is obliged to inform the issuing bank of the cancellation of the transaction. The bank will process the transaction according to its contract with the customer and the COMPANY shall have no further responsibility. After making such notification the COMPANY has no responsibility for the time and manner of execution of the refund, which is governed by the abovementioned contract. In the case of cash payment, if the customer chose the “collect from store” option, he can be refunded at any branch of the COMPANY’s network. In the case of a bank transfer payment, a bank transfer will be made from the COMPANY account to the customer account.

• In the event that products are returned damaged or incomplete, the Online Shop has the right to claim compensation from the customer, the amount of which will be determined by the condition of the products and unilaterally and unconditionally made in total or partial offset of the claim against the customer.

Returning products which are considered defective on delivery (DOA)

Refunds of products that are considered defective on delivery (DOA) will be accepted within seven (7) calendar days of delivery to the customer. In addition, the product should not be damaged and must have all the original accompanying documents (eg ID card, retail receipt and so on) and full packaging. In these cases, the following shall apply:

• The product is received and inspected to determine the defect reported by the CUSTOMER.

• Once received and checked by the COMPANY, the item will be replaced with a new one or, in the case of unavailability, with another new product of the same quality and price, otherwise, if the customer does not wish the item to be replaced, the original purchase price will be refunded to the customer, via the same method by which the customer made the original payment to the COMPANY

• In the case of credit card payment, the COMPANY is obliged to inform the issuing bank of the cancellation of the transaction. The bank will process the transaction according to its contract with the customer and the COMPANY shall have no further responsibility. After making such notification the COMPANY has no responsibility for the time and manner of execution of the refund, which is governed by the abovementioned contract. In the case of cash payment, if the customer chose the “collect from store” option, he can be refunded at any branch of the COMPANY’s network. In the case of a bank transfer payment, a bank transfer will be made from the COMPANY account to the customer account.

• Shipping costs for return of the products to the COMPANY and for the return to the CUSTOMER of the replacement product shall be borne by the COMPANY.

• In the event that products are returned damaged or incomplete, the Online Shop has the right to claim compensation from the customer, the amount of which will be determined by the condition of the products and unilaterally and unconditionally made in total or partial offset of the claim against the customer.

Return of non-defective products – Customer’s Right of Withdrawal

The CUSTOMER has the right to withdraw from the purchase contract within 14 calendar days of delivery (in the case of products) or, if there are multiple products in the same order, from delivery of the last product while there is an obligation to deliver products at regular intervals from the delivery of the first. Withdrawal is subject to the following conditions:

• Withdrawal is justifiable and without any charge, and if the item has already been delivered, the customer must return the product exactly in the condition received, with all its parts and accompanying forms and its packaging in excellent condition. Return of the item is accepted only if the purchaser has first paid any amount already paid by the company for the shipment of the item to him and for shipping costs for the return of the item.

• The withdrawal statement must be made in writing or electronically and the COMPANY is obliged to acknowledge receipt promptly.

• Following the withdrawal notice, the COMPANY is obliged to refund the price paid within 14 days of receipt of the products.

• Return shipping costs are not refunded if the customer had chosen a delivery method other than the cheapest standard delivery method offered by the COMPANY.

• Monies will be returned to the customer by the same means as their original collection. In the case of credit card payment, the COMPANY is obliged to inform the issuing bank of the cancellation of the transaction. The bank will process the transaction according to its contract with the customer and the COMPANY shall have no further responsibility. After making such notification the COMPANY has no responsibility for the time and manner of execution of the refund, which is governed by the abovementioned contract. In the case of cash payment, if the customer chose the “collect from store” option, he will be refunded at the branch used for collection. In the case of a bank transfer payment, a bank transfer will be made from the COMPANY account to the customer account.

•  The customer is responsible for compensating the company if he has made any use of the product other than that necessary to ascertain the nature, characteristics and operation of the goods in the period up to the date of the declaration of withdrawal. The nature, characteristics and operation of the goods should be ascertained on the basis of the information provided on the outer packaging of each product as well as the additional information provided by the company and without opening the packaging of the goods and operating the product. The company is willing to respond to any query from the customer about the nature and operation of the products by providing additional information in electronic or other ways. Opening the packaging or operating the products causes their value to be automatically reduced as the product is then deemed to be second-hand and the customer must compensate the company for the reduction in the value of the product. The reduction in value resulting from opening of the packaging and, consequently, from the product’s designation as a second-hand item is determined on a case-by-case basis by the company and is usually in the order of 20% -30%. The COMPANY is also entitled to agree its compensation with the customer by mutual offsetting.

• In the event that products are returned damaged or incomplete, the Online Shop has the right to claim compensation from the customer, the amount of which will be determined by the condition of the products and unilaterally and unconditionally made in total or partial offset of the claim against the customer.

Safe Products – Warranty Terms

The products available from the COMPANY are durable products bearing all necessary authentication. The products are accompanied by written cleaning instructions, in Greek.

 

The warranty form always includes the name and address of the guarantor, the product to which the warranty relates, its exact content, its duration, its local area of validity, and the rights conferred by applicable laws.

 

The duration of the warranty of the device will be as stated by the manufacturer from the date of purchase and allows defects to be rectified free of charge, provided the following conditions are met:

• The dealer’s guarantee and proof of purchase of the device are produced

• The fixed components of the device have not been tampered with (SerialNo.)

• The fault is not excluded in the manufacturer’s written guarantee for the device.
